My Thoughts on Yet Another Lawsuit

For those that haven’t heard the wonderful news of the day, yes, I was sued back on Dec. 21st by the production company of the “Bachelor” series for ummmmm, well, I’m still trying to figure out what. The Hollywood Reporter covered it today, as well as You can see in the Hollywood Reporter story that I give my response to this lawsuit.

Let me just say this: all the armchair lawyers out there can say what they want, but the truth is, the Settlement Agreement I have with NZK Productions is not public record. If you don’t know the exact wording in the Settlement Agreement, you can’t possibly have an accurate opinion on these new charges brought against me, so just keep that in mind before I’m vilified in the court of public opinion. The point of the Agreement, or so I thought, was to prevent this exact thing from happening. I didn’t want to have to respond to a lawsuit every single time I posted a spoiler on my site because NZK Productions THINKS I got my information illegally. But that’s exactly what they went ahead and did since they have shown me no proof that I violated the Agreement, because they have none.

I continue to spoil their show every season, they’re pissed about it, so this is how they respond. What’s funny in all this is, by suing me, they’re admitting that my spoilers are correct. Do you honestly think if I gave away the wrong ending, and wrong eliminations, and wrong details about the dates they would sue me? Of course not. I’d just be a gossip site and they’d never acknowledge my existence. So I guess props to me for, once again, another successful season of spoiling the “Bachelor” franchise. Although, I didn’t need a lawsuit thrown in my face four days before Christmas to know that my spoilers were right.

I’m exploring all my legal options at this point, including a counterclaim. They are the big guys and I’m the little one and they are trying to squash me. I don’t see that happening since I did not violate our Agreement, nor did I intentionally interfere with any contracts, which is what their latest complaint is stating.

Everything remains the same on the site. I’ll return Tuesday with your episode 1 recap and the spoilers remain up. The only spoilers I haven’t posted yet are episodes 6 and 7. Not too concerned about those right now so you can find all your spoilers by clicking this link, or by navigating at the top of the page by going to “Spoilers,” then “The Bachelor,” then “Bachelor Sean Spoilers.” It’s really easy for those who might be struggling a bit.

    I found the wording “Upon information and belief” interesting. I’m guessing that “Information” is the fact that Steve posted it. “Belief”??? They believe he rec’d it from one of the also sued “10 [John/Jane] Does”???

    Does every lead there ever was get an advance copy? The reason I ask it because Mills retweeeted:

    Inhouse legal departments are never inexpensive and know better than to file frivalous lawsuits. This suit is not without conclusive merit. Oops.

    Non-disclosure agreements are rock solid. Oops.

    Any way you look at this, it’s going to cost RS a bundle on top of the bundle he’s already paying off. Oops.

    In-house legal departments are always inexpensive; they are already on the payroll.

    This suit may or may not be with merit. Either way, it costs RS boatloads to defend. Damage done.

    @freeasabird- i also found the wording “upon informationa and belief” interesting.. i agree that the “information” aspect comes directly from the spoilers that have been posted by steve so far.. as for the belief portion of the suit, ABC seens to assume that there is no possible explanation for the in-depth detail of the first 5 ep by ep spoilers without concluding that steve has been eliciting information from contestants or crew, thus encouraging them to breach their confidentiality agreements, which is illegal. i do find it interesting that they do not mention anyone in particular, so the lawsuit could very well be based on pure speculation..

    but as carol stated above, it is very inexpensive for ABC to use their own in-house council.. if they lose this suit, it costs them nothing- unless, of course, steve wins his countersuit.. unfortunately, it is steve who has to fork up the funds to cover these suits, whether they are legitimate or not..

    @freeasabird, thank you for posting the link to the lawsuit. I just browsed through it and it does look like this is based on pure speculation at this point. I may be wrong, but it just seems to me that Fleiss, ABC, and the production company are bitter and angry that Steve is still able to spoil the show and they’re trying to do whatever it takes to get him to stop. Maybe they think if he has to keep coughing up thousands of dollars of legal fees, he’ll give up. Sucks.

    New season starts tonight but I have to admit I’m far more excited about the return of other shows than I am about the Bachelor. @Randais, I’ll have to go back and look but I think Deception is the new show you mentioned that looked good? I plan on checking that one out too although I’ll probably catch it later in the week. Hard for me to watch shows that come on 10-11 PM during the week. Well except for Scandal, because that one’s always worth staying up for.

    I totally geeked out to reading spoilers for Revenge season 2 this morning after the great episode last night.

    Spoiler episode 12 (episode 10 was last night): With Emily by his side, Daniel goes toe to toe with his fiercest business rival, Jason Prosser, to land an important deal that Victoria is determined to block. Aiden takes a very dark turn, and Jack and Amanda’s future lands in the unlikely hands of Conrad Grayson.

    Who is Aiden pointing that gun at, and how did Ashley Davenport get back inside Grayson Manor unscathed?

    Show creator and writer Mike Kelly said in an interview that he is re-tweaking the second half of season 2 to make the main focus on Emily and her relationships and to clear things up about The Initiative.

    He “gets” that people are annoyed and confused about the main sub-plot centering around The Initiative.

    My personal favs on the show are Nolan – love the way the actor conveys so much emotion in his character, and I can’t get enough Victoria. 🙂

    LOVE the red sharpie too! Glad to see it’s return!

    Are Marco and Padma working for The Initiative?

    And I think Jack is to galactically stupid to be a good match with faux Emily.

    Hope the show kills off both Porter boys.


    Not as excited to watch this season, but I think Sean is a good catch.

    Another spoiler, read an interview with Gabriel Mann, the character that plays Nolan, where he said his love interest will always be Emily. Wow. I thought he was looking out for her because they were somehow connected via bloodlines as family, so this surprised me. But it makes sense now that he is jealous of Aiden.

    n. a phrase often used in legal pleadings (complaints and answers in a lawsuit), declarations under penalty of perjury, and affidavits under oath, in which the person making the statement or allegation qualifies it. In effect, he/she says: “I am only stating what I have been told, and I believe it.” This makes clear about which statements he/she does not have sure-fire, personal knowledge (perhaps it is just hearsay or surmise) and protects the maker of the statement from claims of outright falsehood or perjury. The typical phraseology is: “Plaintiff is informed and believes, and upon such information and belief, alleges that defendant diverted the funds to his own use.”

    Hahaha… did you see Primetime in No Time? Around the 3:38 mark, Theo Von says he can’t wait to see the premiere of the new Bachelor: “I can’t wait to see who Sean decides to get engaged to and then break up with.” Bwahahahaha!

    Can anybody else NOT find the links to Sean’s “girls” for this season? I can’t find them…..maybe I’m looking in the wrong place. I though Steve had links at the top of the page so you didn’t have to go way back to the first column where he listed them….

    @iheart – YES, Deception. NBC’s answer to Revenge, I’m thinking. It looks interesting.

    Who would have thought that someone would leave in the first episode? Figures it was someone on Jillian’s team, she’s so intense AND BAM she’s down 2 players! Now we know how the kids play into this and I like how they are incorporating them into the show.

    Awesome as usual. Interesting parting shot, with Aidan “glaring” at Emily from the shadows. Anyone else think he’s got a dark side?
    @addicted – I didn’t see Ashely in last nights episode at all, save for the flashback to Daniel finding her in her robe while she declared her innocence. OH and oops, I see now that you, too, noticed Aidan’s “dark side”..and I second the “killing off of the Porter boys”, not holding my breath but they are evil.

    Who watches? I have to admit I did NOT see that final scene coming….Micheal J Fox’s character “bought the firm’s debt”. That one caught me off guard.

    This attention grabbing lawsuit will backfire for ABC. Fleiss is a success in spite of himself. People are standing up for their freedom of speech.

    I think the whole thing is silly because I would have stopped watching The Bachelor seasons ago if you didn’t post spoilers. I am not interested in the suspense. I much more enjoy knowing ahead of time and watching to see it all play out. Looking to see how obvious or hidden the final four are. I think ABC should thank you! I know of several others who feel the same way.

    kasey, there’s been a problem with the comments section the past few days. I sent RS an email to let him know I was having problems posting comments, and he, very nicely, responded to let me know the reason why. I believe it had something to do with trying to catch/screen a particular whacko poster by keywords used in their comments. He took care of my problem immediately.

    I didn’t watch last night and look forward to reading everyone’s comments! I’m hoping to watch it soon.

    Thanks iheart – found them – not sure where I was looking! I found the 50 Shades girl funny, especially at the end….wasn’t really impressed with any of the girls. I liked Tierra sorta but then I see on the previews how she acts the rest of the season…cray cray. I also thought Catherine’s comment about “you’re such a hunk” was kinda cheesy. She is cute though, except for the little bitty nose ring. The wedding girl dress I see makes final 4! Wow….and I also see how Sean kept all but one of the minorities on the show…..hmmm….interesting. I wonder if the producers had anything to do with that?? 🙂 I really love knowing who he picks – it does make it much more interesting to me to see how it unfolds – even the final 4. So ABC I hope you are reading this. People watch this show because of RS and his spoilers!!

    So, if I’m to understand the attorneys on the site correctly, if someone from the show contacts RS and offers him information, does RS have to say “NO” in order for anything that is subsequently provided anyway not to violate the law?

    “BIGGEST LOSER” (last night)
    I love Bob. I think it was brilliant to bring in all the athletes to help work the contestants.
    Jillian never ceases to amaze with her whacko crazy intensity! Danni was pretty much a superstar for this team, thank goodness they at least have her! At the team challenge, I was surprised that the red team sent out a girl for the third leg, it seemed to me to clearly be geared for a guy’s strength.AMAZING that the white team won again! It didn’t help them in the end last week AND it didn’t help them again this week. And bam, Jillian’s down another one…only 2 left.
    I thought Bob’s team had completely avoided the “2nd week curse” until Jeff lost nothing :(. Close call, blue team.
    I’m really enjoying the kids aspect of this season. I like that they aren’t subjecting them to a weigh in, that could be so traumatizing for children. I also, LOVE Bob’s humor, if I were one of the contestants, his humor would totally motivate me.

    Strick432, it really makes a difference, doesn’t it? You watch it in a different way and I think it makes it better too. It enhances the show. I know a lot of people feel the opposite, and I respect that, but I LOVE the spoilers.

    How did I miss the Revenge posts yesterday? And @Randais, wait, the Porter brothers are evil?? Did you mean to say the Ryan brothers are evil? The Porter brothers are kind of lame and don’t add a whole lot to the storyline, true, but they’re definitely not the bad guys. 🙂 I would much rather see the Ryan brothers go down but since Mike Kelley leaked that it is a character that has a major impact on the show, I’m not holding my breath.

    @athena- it’s hard to tell… the settlement states that RS cannot contact directly or indirectly anyone from the show, including contestants or crew members.. but the wording is tricky.. it says HE cannot contact THEM directly or indirectly.. it doesnt specificall say they cannot contact HIM first.. if it said, rs cannot have direct or indirect contact with the contestants or crew, then i would say “yes”.. but the agreement sounds like he cannot contact them first.. either way, he is NOT allowed to contact them and encourage them to breach their confidentiality agreement, that is against the law..

    Think about this people, if Fleiss/ABC was THAT concerned about Steve and his spoilers getting out, why on earth would they draw attention to it even more by having lawsuits? Because it keeps their little show in the media, that’s why. What’s the best way for Steve to get these spoilers, some in great detail? THEY feed the info to him themselves! Give Steve spoilers, get people to read and watch more, Fleiss complains on Twitter to the world, gets more people talking, threaten lawsuit, get more people interested, lather rinse repeat. They aren’t stupid, they are aware people that read spoilers are even more likely to watch the show. Either Steve is being duped by ABC, or he is happily working for them ? I demand a donate button right meow. Ha!

    I have to say I enjoy knowing the spoilers and who the winner is as I watch the show and seeing how the relationship unfolds between the lead and winner. steve is funny and I see no harm in his spoilers. if you don’t want to know what happens then don’t read them…no one accidently runs across this site and accidently sees the spoilers…
    not sure I agree with his final choice, but to each his own…

    I would not even watch this show if it wasn’t for your website. 1) The spoilers do not make that much of a difference to me because like you have said, they’re not going to get married anayways. But 2) your recaps are frickkkin’ hilarious. I can’t wait to read them BEFORE I watch this weekly train wreck on my DVR. If anything I was thinking about not watching because you’d been slacking off on getting the recaps posted. So if you’re serious about being timely this season, I will keep tuning in. If there’s mny other viewers out there like me, who need to be spoon fed before the mind numbing,then rating will take a hit if they shut you down.

    @lobsterandbeer, I agree completely. And the timing of it makes it so obvious ABC/Fleiss knows what they’re doing. I can’t imagine RS has gotten under Fleiss’s skin so badly that ABC would allow him to do things not good for his show. Though the lawsuit does make ABC/Fleiss look like pathetic bullies. Your conclusions are similar to mine too. Either they’re using him to pump up ratings for this season, or they have some type of secret agreement with him.

    Did you see Jimmie Kimmell last night? He showed Sean Lowe his final 4 predictions last night. Guees what? Yeah, straight off the Reality Steve website; the very same 4 you reported on. Why isn’t Jimmie Kimmell being sued? Man, if ABC is using your material on another show, it makes no sense that Fleiss can claim that you are hurting his ratings.
